At commencement of employment, whether acting for employer or employee, we draft and review offers letters, employment contracts and directors’ service agreements.  Where necessary, we can revise foreign contracts to make them compliant with English law and are well versed in the differences and nuances between the laws in the US, Canada and other territories compared to English law.  We can advise on the distinction between employees and independent contractors to determine your requirements or where the position is unclear.  We can guide you through the protection of confidential information and use of restrictive covenants.

As part of an employment package or as the relationship progresses, we can advise on employee share option schemes and the provision of pensions, benefits and bonuses.

To support the contractual documentation, we can carry out any necessary risk assessments and prepare the staff handbook and other HR policies you may need to govern how your employees should act and the procedures for handling employment-related matters.

Where you are carrying out a corporate transaction or restructuring, our Employment team can support the corporate function and advise in particular on the effect of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE) and any consultation obligations.

If issues arise, we can assist with disciplinary, performance and grievance procedures, termination of employment including redundancy procedures, and compromising or defending employee claims such as unfair dismissal and discrimination.
